Estimados miembros de la Coalición JUSTICIA,
TALLER INTERNACIONAL PARA REPRESENTANTES GUBERNAMENTALES. Esta semana llevamos a cabo un taller en Miami para las oficinas nacionales del Derecho de Autor con participación de representantes de 7 países de la región. Como parte del programa, incluimos presentaciones de artistas y productores quienes expresaron a los gobiernos sus preocupaciones en torno al desarrollo vertiginoso de la IA y la necesidad de preservar los derechos de propiedad intelectual en este entorno. Este taller también sirvió de marco a la presentación de la Coalición Justicia, sus principios básicos, la declaración conjunta y quienes son los miembros de la Coalición. Esperamos el año entrante continuar expandiendo este tipo de actividades que nos permiten llegar a los gobiernos en forma efectiva y, sobre todo, que nos tomen en cuenta a la hora de proponer cambios legislativos en sus países.
NUEVOS MIEMBROS DE LA COALICION: La damos la bienvenida a la Coalición a ADMI (Asociación de Disqueras Mexicanas Independientes) y a ALDISCO (Alianza Discográfica de Colombia), ambas organizaciones representativas de productores fonográficos independientes en sus respectivos países. Con estos nuevos miembros ya suman 44 las organizaciones que forman parte de la Coalición Justicia.
NOVEDADES LEGISLATIVAS: El 6 de octubre el Proyecto de Ley sobre Inteligencia Artificial que se tramita en la Cámara de Diputados de Chile recibió el voto favorable en la Comisión de Futuro, Ciencias, Tecnología, Conocimiento e Innovación y fue enviado al pleno para ser votado la semana entrante (13 de octubre). Este proyecto contiene disposiciones muy positivas para nuestro sector tales como la obligación de identificación del contenido generado por IA y la clasificación de incidente grave a las violaciones a los derechos de autor. Sin embargo, el proyecto adolece de falta de obligaciones claras de transparencia para que los desarrolladores y operadores de sistemas y modelos deban reportar en forma clara y precisa los contenidos utilizados en labores de entrenamiento (ver texto anexo). Estaremos acompañando este proyecto en su tramite en el Senado para presentar nuestro apoyo a las disposiciones favorables, así como nuestro pedido de mejoramiento de otras disposiciones. Encontramos un proyecto de ley sobre inteligencia artificial que se tramita en el Congreso de Bolivia, el texto oficial esta disponible aqui. Este es un texto que no contiene las necesarias salvaguardas a los derechos de propiedad intelectual y por ello vamos a formular comentarios en nombre de la Coalición. Finalmente, hemos recibido el texto de la “Ley de Fomento a Inteligencia Artificial y Tecnologías” de El Salvador cuyo texto oficial pueden consultar aqui. Esta ley constituye un precedente que no toma en cuenta la necesaria protección a los derechos de propiedad intelectual y es por ello que vamos a elevar una petición a la Agencia Nacional de Inteligencia Artificial (ANIA), para que en el marco de la reglamentación normativa se precisen estas salvaguardas y muy especialmente las obligaciones de transparencia y reportes.

Dear members of the JUSTICE Coalition,
INTERNATIONAL WORKSHOP FOR GOVERNMENT REPRESENTATIVES. This week we held a workshop in Miami for national copyright offices with the participation of representatives from seven countries in the region. As part of the program, we included presentations by artists and producers who expressed their concerns to governments about the rapid development of AI and the need to preserve intellectual property rights in this environment. This workshop also served as a framework for the presentation of the Justice Coalition, its basic principles, the joint declaration, and who the members of the Coalition are. We hope to continue expanding these types of activities next year, which allow us to effectively reach governments and, above all, to be taken into account when proposing legislative changes in their countries.
NEW MEMBERS OF THE COALITION: We welcome ADMI (Association of Independent Mexican Record Labels) and ALDISCO (Colombian Record Alliance) to the Coalition, both organizations representing independent phonographic producers in their respective countries. With these new members, there are now 44 organizations that are part of the Justice Coalition.
LEGISLATIVE NEWS: On October 6, the Artificial Intelligence Bill being processed in the Chamber of Deputies of Chile received a favorable vote in the Future, Science, Technology, Knowledge, and Innovation Committee and was sent to the plenary for a vote next week (October 13). This bill contains very positive provisions for our sector, such as the obligation to identify AI-generated content and the classification of copyright violations as serious incidents. However, the bill lacks clear transparency obligations for developers and operators of systems and models to report clearly and accurately on the content used in training tasks (see attached text). We will be following this bill as it makes its way through the Senate to express our support for the favorable provisions, as well as our request for improvements to other provisions. We found a bill on artificial intelligence being processed in the Congress of Bolivia. The official text is available here. This text does not contain the necessary safeguards for intellectual property rights, and we will therefore be submitting comments on behalf of the Coalition. Finally, we have received the text of the “Law on the Promotion of Artificial Intelligence and Technologies” of El Salvador, the official text of which can be consulted here. This law sets a precedent that does not take into account the necessary protection of intellectual property rights, and we will therefore submit a request to the National Artificial Intelligence Agency (ANIA) to ensure that these safeguards, and in particular the obligations of transparency and reporting, are specified in the regulatory framework.
